1. ELIGIBILITY
1.1 NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR
CHANCES OF WINNING. Void where prohibited by law.

1.2 This promotion (the “Promotion”) is open only to legal residents of the United States who are twenty-one (21) years of age or older as of October 28, 2025.
1.3 Employees, officers, directors, and agents of Hocker Productions, LLC (“Sponsor”), Palm Springs Food & Wine Festival, participating vendors, prize suppliers, and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members (spouse, parents, children, siblings, and their spouses) and those living in the same household of such individuals, whether related or not, are not eligible to participate or win.
1.4 Winners must provide valid government-issued photo identification showing they are 21 years or older to claim prizes containing alcohol.
1.5 Participation in this Promotion constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion.

2. PROMOTION PERIOD
2.1 The Promotion consists of seven (7) separate daily prize periods:

Day 1: Tuesday, October 28, 2025, 12:00:00 PM PST to 2:00:00 PM PST
Day 2: Wednesday, October 29, 2025, 12:00:00 PM PST to 2:00:00 PM PST
Day 3: Thursday, October 30, 2025, 12:00:00 PM PST to 2:00:00 PM PST
Day 4: Friday, October 31, 2025, 12:00:00 PM PST to 2:00:00 PM PST
Day 5: Saturday, November 1, 2025, 12:00:00 PM PST to 2:00:00 PM PST
Day 6: Sunday, November 2, 2025, 12:00:00 PM PST to 2:00:00 PM PST
Day 7: Monday, November 3, 2025, 12:00:00 PM PST to 2:00:00 PM PST
2.2 Sponsor’s ticketing system computer is the official time-keeping device for the Promotion.

3. HOW TO ENTER
3.1 Entry by Purchase (Automatic Entry):

Eligible participants may enter the Promotion by purchasing one or more tickets to the Palm Springs Food & Wine Festival through the official website (palmspringsfoodandwine.org) during any daily prize period specified in Section 2.1.
Entry Method:

Navigate to palmspringsfoodandwine.org Select and purchase festival ticket(s)
Complete purchase transaction between 12:00:00 PM and 2:00:00 PM PST on the applicable day Retain order confirmation
The timestamp of the completed order (as recorded by Sponsor’s ticketing system) serves as the entry timestamp. Each completed purchase transaction during a prize period constitutes one (1) entry for that day’s prize drawing only.
3.2 Alternative Method of Entry (AMOE) – No Purchase Necessary: MAIL-IN ENTRY ONLY (no electronic entries will be accepted)
To enter without purchase, eligible participants must send a handwritten request on a 3″x5″ card including:
Full name
Complete mailing address Phone number
Email address
Date of birth (to verify age 21+)
Which daily prize period you wish to enter (Days 1-7)
Your chosen entry time in HH:MM:SS format (example: “01:23:47 PM”) Must be between 12:00:00 PM and 2:00:00 PM
Include hour, minute, and second

AMOE Deadlines: Requests must be postmarked by 11:59 PM PST on the day BEFORE the prize period you wish to enter.
Example: To enter Day 3 (Thursday, October 30), your postcard must be postmarked by Wednesday, October 29 at 11:59 PM PST.

Why This Works: Your chosen time on the postcard functions exactly like a purchase timestamp. You select your “entry time” just as purchasers select when to buy. Both entry methods compete equally based on proximity to the random time.
Limit one (1) AMOE entry per person per daily prize period. Illegible, incomplete, or bulk AMOE entries will be disqualified.
3.3 Entry Limits:

Purchase Entries: No limit on number of ticket purchase entries per person per day. Each separate purchase transaction = one entry.
AMOE Entries: One (1) AMOE entry per person per daily prize period.
Entries from prior days do not carry over. Each day is a separate promotion.
Automated or robotic entries, bulk entries, or entries made through third parties are prohibited and will be disqualified.

4. WINNER DETERMINATION
4.1 One (1) winner will be selected for each daily prize period.

4.2 Selection Method:

After the close of each daily prize period at 2:00:00 PM PST, Sponsor will:

1. Compile all eligible entries received during that day’s prize period
2. Generate a random timestamp between 12:00:00.000 PM and 2:00:00.000 PM PST using a certified random number generator
3. Determine which entry’s timestamp is closest (before or after) to the randomly generated timestamp
4. The entry with the timestamp closest to the random time (measured in milliseconds) will be deemed the potential winner
4.3 Tie-Breaking:

In the extremely rare event of an exact millisecond tie, the entry that was processed first by Sponsor’s system will be deemed the winner.
4.4 Verification:

All potential winners are subject to verification before any prize is awarded. Sponsor reserves the right to require proof of purchase, identification, and eligibility before awarding any prize.
4.5 Winner Notification:

Potential winners will be announced publicly on Sponsor’s social media channels at 9:00 AM PST the morning following the prize period close. Winners will also be notified via email at the address provided during ticket purchase (or AMOE entry) within twenty-four (24) hours of winner determination.

4.6 Disqualification and Alternate Winners:

If a potential winner:

Cannot be contacted
Fails to provide required documentation Is found to be ineligible
Has not complied with these Official Rules Declines the prize for any reason
…then that potential winner will be disqualified and an alternate winner may be selected from remaining eligible entries for that day at Sponsor’s discretion.

5. PRIZES

Total ARV of All Prizes: $3,066+

5.2 Prize Claim Deadline:

All prizes must be claimed by 4:00 PM PST on Saturday, November 15, 2025, at the Ticket Coordinator Booth at Palm Springs Food & Wine Festival held at Palm Springs Stadium. Prizes not claimed by this deadline will be forfeited with no exceptions.
5.3 Prize Claim Requirements:

Winners must present at the Ticket Coordinator Booth:

Valid government-issued photo identification proving 21+ years of age
Order confirmation email (for purchase entries) or winner notification email Completed prize claim form (provided on-site by Sponsor staff)
5.4 Prize Conditions:

Prizes are awarded “as is” with no warranty or guarantee, express or implied Prizes are non-transferable except at Sponsor’s sole discretion
No cash equivalent or prize substitution allowed except at Sponsor’s discretion
Sponsor reserves the right to substitute prizes of equal or greater value if original prize becomes unavailable
All prize details are subject to change based on vendor availability
Wine/alcohol prizes require winner to be 21+ with valid ID verification
Cooking class must be scheduled based on vendor availability and is subject to vendor’s scheduling policies
Vineyard tours must be scheduled in advance with the vendor and are subject to vendor policies and availability
Winners are responsible for any costs and expenses not specified as included in prize description (including but not limited to transportation, lodging, meals, taxes)
5.5 Limitation:

An individual may only win one (1) prize during the entire Promotion period (all seven days combined). If an individual is selected as a winner for multiple days, they will only receive the first prize won chronologically and an alternate winner will be selected for subsequent days.
5.6 Ticket Purchases:

Winners who entered via ticket purchase will receive BOTH their prize AND their festival tickets. Ticket purchases are final and non-refundable regardless of prize outcome.

6. TAXES AND FEES
6.1 Winners are solely responsible for all federal, state, and local taxes and any other costs and expenses not specified herein as being awarded.
6.2 Winners will receive IRS Form 1099-MISC if the aggregate retail value of prizes received exceeds
$600 in a calendar year. Winner must provide Social Security Number or Taxpayer Identification

Number for tax reporting purposes.

6.3 California law requires Sponsor to report prizes with retail value exceeding $600 to the California Franchise Tax Board.

7. GENERAL CONDITIONS
7.1 Consent to Use of Information:

By entering, entrants consent to Sponsor’s collection and use of their personal information solely for purposes of administering this Promotion and as described in Sponsor’s Privacy Policy available at pal mspringsfoodandwine.org/privacy-policy.
7.2 Publicity Release:

Except where prohibited by law, entry and acceptance of prize constitute permission for Sponsor to use winner’s name, likeness, prize information, and city/state of residence for advertising and promotional purposes without additional compensation.
7.3 Release of Liability:

By participating, entrants agree to release and hold harmless Sponsor, Palm Springs Food & Wine Festival, prize suppliers, and their respective parents, subsidiaries, affiliates, officers, directors, employees, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the Promotion or acceptance, possession, use, or misuse of any prize.
7.4 Limitation of Liability:

Sponsor is not responsible for:

Lost, late, incomplete, stolen, misdirected, illegible, or postage-due entries Technical, hardware, software, or telephone failures of any kind
Internet unavailability or inaccessibility
Unauthorized human or electronic intervention
Printing, typographical, or human errors in any Promotion-related materials
Incorrect or inaccurate entry information, whether caused by equipment, programming used in the Promotion, or by human error
7.5 Force Majeure:

If the Promotion is interfered with in any manner or is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect administration, security, fairness, integrity, or proper conduct of the Promotion, Sponsor reserves the right to cancel, terminate, modify, or suspend the Promotion and select winners from eligible entries received prior to action taken.
7.6 Disqualification:

Sponsor reserves the right to disqualify any individual found to be:

Tampering with the entry process or the operation of the Promotion Operating in violation of these Official Rules
Acting in an unsportsmanlike or disruptive manner
Intending to annoy, abuse, threaten, or harass any other person
7.7 Prize Delivery:

Prizes will be distributed at the Palm Springs Food & Wine Festival as specified in Section 5.2. Some prizes (such as vineyard tours and cooking classes) require scheduling with third-party vendors and may take longer to coordinate after initial claim.

8. DISPUTES AND GOVERNING LAW
8.1 These Official Rules and the Promotion shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions.
8.2 By entering, entrants agree that any dispute, claim, or controversy arising out of or relating to these Official Rules or the Promotion shall be resolved individually, without resort to any form of class action, exclusively through binding arbitration conducted in Riverside County, California, in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
8.3 Entrants waive any right to a jury trial and agree that any litigation (if arbitration is found to be inapplicable) shall be conducted only in the state or federal courts located in Riverside County, California.

11. CALIFORNIA-SPECIFIC PROVISIONS
11.1 No Purchase Necessary Statement:

Pursuant to California law, this promotion is structured to provide equal opportunity to all participants. The Alternative Method of Entry (AMOE) provides a free entry method that functions identically to the purchase entry method.
11.2 Consumer Protection:

This Promotion complies with California Business and Professions Code §§ 17539 et seq. regarding promotional contests and sweepstakes.
11.3 Age Verification:

Because some prizes contain alcohol, compliance with California Alcoholic Beverage Control laws requires prize recipients to verify age 21+ with valid government-issued identification before claiming alcohol-containing prizes.

12. MISCELLANEOUS
12.1 If any provision of these Official Rules is held to be invalid or unenforceable, all remaining provisions will remain in full force and effect.
12.2 Sponsor’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
12.3 These Official Rules constitute the entire agreement between entrants and Sponsor regarding the Promotion.
12.4 Captions and headings are for convenience only and do not affect interpretation of these Official Rules.

By entering this Promotion, entrants acknowledge that they have read, understood, and agree to be bound by these Official Rules.
